Legal Answers
Q. Why would I appoint my aunt to administer my father's estate?
A: If a will doesn't exist when someone dies the estate goes through an administration. During this process the court appoints someone to administer the estate. Usually a child of decedent would have priority over a sister in administering an estate, but without knowing more, there may be countless reasons that your Aunt would be a good choice for this position. The court is the one to appoint the administrator, not you.
Q. My step mother died recently with no will I was the POA during her illness a house and debt was left by her.what do i do
A: Once someone passes their Power of Attorney is no longer valid. It is now up to the personal representative named in your step mother's will to take over the probate of the estate through court. During that process the bills will be paid and the house will pass to the legal heirs.
