Biography

Jon is a native of Beaumont, Texas and spent most of his childhood there as well as Santa Fe, New Mexico and Denver, Colorado.

Jon attended American University in Washington, DC and earned two Bachelor of Arts degrees, one in International Studies, with a focus on international trade and finance; and another in Justice, focusing on organized and white collar crime as well as policing methodology. While at American University, Jon was an elected member of student government and very active in the American University and Washington, DC chapters of the College Republicans.

Jon has worked in the finance and real estate fields at a variety of levels, including as a foreign exchange broker, real estate agent and commodity futures broker. As well as owning and operating several successful small businesses.

Moving to Hendersonville, Tennessee, Jon founded the Rogers Law Group in 2011 with a focus on a client-centered law practice, which prides itself on focusing exclusively on Criminal, Civil and Real Estate Litigation.

Q. How much jail time do I get for failing a drug test on community corrections on a 4yr sentence 1st violation
A: Generally, when someone violates a community corrections sentence, the original sentence COULD be put into effect. In a CC sentence, there IS credit for time served on probation (aka "street credits"). I say could be put into effect, because it is possible if your PO and the judge are willing, you could be placed back into CC.

The bad news is, at least in my experience, this is uncommon. Generally a CC sentence is considered the "last chance" prior to incarceration and violating on CC has almost always, again, in my experience, resulted in a sentence being put back into effect.

Big factors are going to be the nature of the violation, your relationship with your PO, by that I mean your performance on probation up to this point and your willingness to make amends.

Based on what you have said, a lot would depend on what you tested positive for (pot is generally treated much more leniently than say cocaine or meth). Did you immediately disclose what happened to your PO? Have you been good on probation other than the failed drug test? What was the original charge for which you received the CC sentence? And what jurisdiction are you in? (Nashville and Memphis generally don't have the time or resources to be as tough as many suburban counties)

I'd suggest hiring an attorney with criminal law experience to assist you. You do not want to go to prison for the balance of 4 years...I'm sure I don't have to tell you that, LOL.

Q. Police at the scene did not issue a ticket or ask for info can I be given a ticket at a later date for DUI
A: Charges can be filed against you at any point within the statute of limitations. However, due to the highly-science-dependent nature of DUI prosecution, if you were not administered field sobriety tests at the scene, nor were you administered blood draws, which were sent to TBI, it is unlikely the police/DA would have a sufficient evidentiary basis to charge you with a DUI as, at this point, any substances in your system have been passed out. I hope that helps.

Q. What charges will I get if a cartridge wasn’t my possession I am 15 years of age
A: The first thing you need to do is let your parents know, and you (you and your parents) need to go speak to a lawyer. Schools are not allowed to question students without someone "friendly" to the student, and no, the school administrators and teachers are usually friendly to the school board. So that could be an issue. Also, who pulled you out of class, was it the principal or someone with the school administration or was it the SRO? I can't tell you what charges you might face because it could be a variety of things. That isn't meant to scare you, and everything will probably be just fine, but you need to let your parents know and you need to talk to an attorney.
