Biography

Gavin was born and reared in Honolulu, Hawai‘i, graduating from McKinley High School, and receiving his Bachelor of Arts in Political Science from Reed College in Portland, Oregon. He received his Juris Doctorate from the University of Denver College of Law in Denver, Colorado. Previously, Gavin worked with the Child Support Enforcement Agency and the AmeriCorps Domestic Violence Clinic.

A supporter of pro bono legal work, Gavin volunteers time with Volunteer Legal Services Hawaii and the Hawai’i State Bar Association. In 2013, Gavin co-authored the book Child Custody Litigation and Settlements (Aspatore Books/Thomson West), writing the chapter “Working with Your Client Towards a Successful Child Custody Case.” Gavin is a member of the Hawaii State Bar Association and the American Bar Association, and was presented with the 2002 Justice Award by the Hawaii State Bar Association, which honors one lawyer annually for their outstanding contribution to the ideals of justice. The Hawaii Access to Justice Commission honored Gavin in 2012 for his pro bono service to the community.

Gavin has extensive experience in divorce, paternity, child custody, child support, restraining orders, prenuptial/postnuptial agreements, and other family law matters, and has been selected for inclusion in the Best Lawyers in America, SuperLawyers, and in Honolulu Magazine's "Best Lawyers in Hawaii." He has a Distinguished rating with Martindale-Hubbell®/Lawyers.com, and an Avvo rating of 10 out of 10.

Q. In the state of Hawaii, can a non-custodial parent relinquish their rights to children and not pay support?
A: The brief answer is that a non-custodial parent cannot relinquish/terminate their rights to their child, nor their child support obligation. The only two exceptions would be (1) the State (through Child Welfare Services/Department of Human Services) terminates the parent's rights to the child as an unfit parent, based on abuse or neglect; or (2) if there is a proposed adopting parent who will take the place of the parent giving up his or her rights (an example would be the new husband of the children's mother adopting the children as the new father, extinguishing the biological father's parental rights - this is typically done with the consent of the biological father).
