I have been involved in the planning, trial and appeal of complex business litigation matters for the past 30 years.

I was born born and raised in Iowa City, Iowa and moved to Houston in 1972, where I worked my way through college and law school. I received a Bachelor of Arts, cum laude, in 1975 from the University of Houston and a Doctor of Jurisprudence in 1979 from the University of Houston Law Center.

After working for one of Houston’s oldest downtown law firms for two years immediately after law school, I was one of the founding partners in 1981 of the Houston business litigation boutique firm that bore my name and became prominent over the next 20 years in complex business litigation matters in Houston and throughout Texas.

In 2000, I established a solo practice in my home, The Woodlands, Texas (35 miles north of downtown Houston), in which I concentrate on personalized representation of clients in complex business litigation matters and utilization of technology applications in such representation.

I have represented a wide variety of clients in complex business litigation in state and federal courts throughout Texas and the United States. My practice has involved trials and appeals in such diverse litigation areas as corporate reorganization and bankruptcy, securities and business fraud, white collar-business criminal cases, anti-trust, real estate, construction, oil and gas, insurance disputes, civil rights, First Amendment issues, defense of civil and criminal contempt matters, and defense of individuals in NCAA Infractions Committee hearings. I maintain an “AV” rating from the Martindale-Hubbell Legal Directory.

I have been a lecturer at the University of Houston Law Center and the University of Texas Law School, and an author and lecturer for the State Bar of Texas Advanced Bankruptcy Seminar and the Houston Bar Association in various areas of business litigation and corporate reorganization law, as well as on the subject of legal research and weblogs. Since February 2004, I have also maintained the popular Houston's Clear Thinkers weblog, which addresses issues of interest for the Houston legal, business, medical and academic communities. I frequently lecture on a variety of business litigation topics for private companies and citizen groups.

Kerrisa Chelkowski's law office is located in San Antonio, Texas. She is a former Bexar County Assistance District Attorney. At the Bexar County DA's office Kerrisa was assigned to the appellate and trial divisions of the office. During her time in the appellate division she handled over 30 cases including death penalty appeals. Within her first year at the office she handled Stewart v. State, a significant DWI case which found itself to the Court of Criminal Appeals. Kerrisa argued that case to the Court of Criminal Appeals in front of a packed house of more than 400 spectators with successful results. Kerrisa also argued numerous times in front of the Fourth Court of Appeals in San Antonio, Texas.

During her time in the trial division Kerrisa tried many cases to juries and to judges of various courts. Kerrisa left the office in 2004 and started her own practice. She concentrates on criminal defense handling both state and federal cases. She continues to try numerous cases to juries every year with (so far) a winning record. Further, she has represented many people in the federal courts across Texas including defendants in the Southwest Airline case where the court dismissed the indictment against her client after filing motions and presenting arguments to the court. Kerrisa is also a Special Prosecutor for the Medina County District Attorney's Office.

Last year Kerrisa presented oral arguments to the United States Court of Appeals for Fifth Circuit in New Orleans, Louisiana. The appellant's sentence was reversed and remanded for a new sentence. Kerrisa has also represented clients on writs of certiorari to the United States Supreme Court. Including both state and federal appeals Kerrisa's name is on over 35 published opinions.

In January and February of 2007, she was featured in NSIDE, a San Antonio business journal, along with other successful business people from generation X. Further, she is a contributing writer for the journal. Her latest article The $25,000 Martini, discusses the financial impact a DWI can have on a professional's life and career. A 1998 University of Texas at Austin alum and 2001 Texas Tech Law School graduate, Kerrisa has built a solid reputation defending high profile cases throughout Texas with successful results.

Before starting his own law practice, Don worked for a well-regarded corporate law firm, for a state attorney general, and as a judicial law clerk. He has seen first-hand how the law is made, how it is shaped by court decisions, and how it affects business clients.

Don began his legal career with a one-year clerkship at the Texas Supreme Court, which is Texas's highest court and focuses on civil (not criminal) cases. Law clerks help the Court evaluate which of the roughly one thousand petitions filed each year should be granted and help the Justices write their opinions.

His private practice began as a litigator for Wachtell, Lipton, Rosen & Katz, a prominent New York law firm. While at Wachtell, Don worked on a variety of high-stakes commercial disputes. The cases included contract law, insurance coverage, business torts, securities fraud, bankruptcy, antitrust law, and federal regulatory investigations. He was a member of the trial team in IBP, Inc. v. Tyson Foods, a landmark merger case in the Delaware Court of Chancery, and also worked on the property-insurance lawsuit filed to help rebuild the World Trade Center. He particularly enjoyed his work on cases involving internet domain names, trademark law, copyright, and sports law.

In 2003, Don returned to Texas to serve as an Assistant Solicitor General (ASG) in the Texas Office of the Attorney General. ASGs are members of the Solicitor General's division, which handles the State's most important appellate cases. Don's cases involved questions of constitutional law and how courts should interpret new statutes. He has argued before the Texas Supreme Court, the United States Court of Appeals for the Fifth Circuit, and other Texas appellate courts.

In 2007, Don started his own law practice based in Austin, Texas.

Summary

I have led many difficult, sensitive representations in 27 years of practicing law and believe I have the talent, intellect, passion, energy, and communication skills that clients both want and need. While my nationwide practice focuses mainly on federal court matters, in each of my representations I try to be as efficient as possible by locating and focusing on the core issues involved. I interact effectively with government officials based on my years of service as a federal prosecutor. If a case must be tried, I am very comfortable with juries and judges from years of trying cases (having tried 100+ cases and having handled dozens of appeals)and teaching trial skills to lawyers and students.

I stay quite active in the legal community and have been selected by my peers for many leadership positions in professional organizations. I am also an Adjunct Professor of Law at the University of Houston Law Center (where I have taught Civil & Criminal Trial Advocacy, Food & Drug Law, and Antitrust & Health Law).

In addition to my J.D., I also have two LL.M. degrees (Tax and Health Law), have been Board Certified in Criminal Law by the Texas Board of Legal Specialization and the National Board of Trial Advocacy since the late 1980's, and have spoken nationally (and internationally) and written about issues in antitrust, compliance, governance, health law, pharmaceutical law, securities law, and white collar defense (among others). I developed and am Editor-in-Chief of a pharmaceutical law treatise published by BNA and the ABA Section of Health Law in 2007 (now in supplementation). I have written many book chapters, dozens of articles, and blog on securities law issues (the FCPA, the subprime market collapse, and the broader financial market). Aimee graduated from Marian High School in Birmingham, Michigan in 1967, with honors. She graduated summa cum laude from Southern Methodist University in 1973 with a B.A. in Economics. She spent a year in graduate studies in economics at SMU, and then attended Southern Methodist University Law School, graduating in 1977. While in law school, she was a law clerk for the Texas Attorney General's Office and wrote for the Southwestern Law Journal.

After graduation from law school, Aimee joined the Dallas firm of Besing, Baker and Glast, and became a partner in 1978. In 1981, she began her own firm, Law Offices of Aimee Hess P.C.

Aimee is currently admitted to practice before the Texas Supreme Court, the U.S. Fifth Circuit Court of Appeals, U.S. District Courts in the Northern, Eastern and Western Districts and U.S. Bankruptcy Courts in the Northern, Eastern and Western Districts.

Aimee concentrates her practice in the areas of real estate and equipment financing (representing both lenders and borrowers), real estate conveyancing (representing both sellers and buyers), real estate and equipment leasing (representing both lessors and lessees), real estate defaults (including work outs and foreclosures), oil and gas law (primarily representing land owners and mineral owners in connection with testing agreements, oil and gas leases and pipeline or access easements), construction law (representing contractors, lenders, and consumers), development law (representing developers from project planning through zoning, construction and lease-up) and representation of rural water and sewer companies (rate-setting; preparation of corporate documents such as tariffs, bylaws and conflicts policies; government loan applications and loan management; and developer and nonstandard service contract negotiations and oversight).

Aimee and her husband Carl Ward, a petroleum engineer, enjoy sailing, hiking, kayaking, windsurfing and finding homes for abused and orphaned dogs, and parrots, many of which share their home at any given time.

The philosophy that guides and informs her law practice is to deliver the very highest quality of legal services to clients on a cost effective basis. She is not only dedicated to her clients' success, she is accessible and down to earth, and keeps an eye on her clients' bottom line.

Most of her clients have been with her for nearly thirty years. Representative clients over the years have included Trammell Crow Company (the largest privately held real estate development company in the world), The Equitable Life Assurance Society, (currently AXA Equitable Life Insurance Company), Coldwell Banker Commercial, and many other real estate investment, development and management companies both large and small. Currently, her clients include several banks and savings and loans, real estate management, development and investment companies, rural water and sewer companies and several construction and manufacturing companies, as well as many small businesses and individuals.

The charges for her services are tailored to fit her clients'needs. Many clients prefer to be billed on an hourly basis. In other cases, where a client prefers and where the subject matter of the representation allows, she offers fixed or a la carte fees.
