Q. Which is the name of the law that determines the percentage of honorary (and the %)the lawyer receive in cases of injury
A: The law is Act No. 9 known as Practice of Law Act and provides:

No attorney shall charge fees of a contingent nature in actions to recover damages in an amount that exceeds, for any reason, twenty-five percent (25%) of the final proceeds of the judgment, compromise or agreement if the client is a minor or mentally disabled, or thirty-three percent (33%) of the final proceeds of the judgment, compromise or agreement if it is any other client.

Q. How can I file a small claims law suit in Puerto Rico? I
A: Good morning:

There is no "small claims" court for personal injury claims in Puerto Rico. You will have to file suit in state court or federal court (if your claim exceeds $75,000 and you and the defendant live in different states). If you plan to sue a cruise ship, be advised that most cruise ship lines have a forum selection clause which require that you file suit in Miami. If the excursion company is based in PR and you live in the mainland US, you are better off filing suit in federal court where you have a right to a trial by jury (provided that you meet the above conditions) which is not available in state courts.

Q. Failure to pay for storage on a boat storage lot
A: Good afternoon:

You must look into Alaska state law for available remedies. If the contract was purely for land storage and no maritime services were rendered, maritime law would not apply and the land owner may not seize (or arrest) the vessel in federal court under admiralty procedures. However, a similar remedy may be available under Alaska law so we recommend you contact a local attorney for advise.
