- Q. The father of my baby says he will support the child. should I still file for child support?
- A: Thank you for your question. Assuming that the father's paternity test was positive, you always have the right to seek child support from him for the benefit of the child, whether now or a few years from now. However, the longer that you go with accepting the goodwill of him and his family, the greater the chance that you may be missing out on months or even years of additional support that he owes under the law. Also, please be aware that you typically cannot seek retroactive support, so if the court determines in a few years that he should have been providing more, you cannot seek reimbursement for that at that future date but only going forward from that point. - Q. Hello, I live in Paramus, NJ. I'm looking to get divorced from my husband, who I've been separated from since 1995.
- A: Thank you for your question. The fact that you have been separated since 1995 - app. 30 years and living in your own in my opinion we preclude you getting alimony.
The other issue is that a separation does not stop the clock on the marriage as only filing a divorce complaint would do that. Therefore you are now married 39 years.
Are you entitled to a division of the assets/liabilities that have been accrued by him and is he entitled to any of the assets/liabilities accrued by you over the last 39 years?
If the separation was 10 or even 15 years I believe you would have a better claim for alimony if the incomes of each of you called for it. Also how old is your husband now? Is he at ... Read More
- Q. Ex was awarded 1/2 my pension. He’s behind in child support. Will this be garnished if still unpaid when I retire?
- A: Thank you for your question. I am sorry that your ex is behind in child support. Yes, in most circumstances, private pensions (but not social security) can be garnished. However, it is not “automatic.” You will likely need to make an application to the Court to establish the garnishment. I strongly suggest you speak to an experienced Family Law attorney regarding this matter.
