Biography

For the past 30 years most of my practice has been asset forfeiture defense (civil and criminal), mostly on the federal level, both in California and out of state. I often co-counsel or consult with attorneys who take on forfeiture cases but lack experience. I also handle appeals, including criminal appeals. I no longer litigate criminal cases at the trial level. I am president of the Board of Forfeiture Endangers American Rights Foundation. I consulted with the late U.S. Rep. Henry Hyde and Rep. John Conyers on an eight year effort to reform federal forfeiture laws, culminating in passage of the Civil Asset Forfeiture Reform Act.

    In certain circumstances I would accept contingency fees. But if the property owner is or may be charged with a crime, there is often a conflict of interest that would prevent me from ethically taking a forfeiture case on a contingency.

    After volunteering for 20 years to answer legal questions from callers to Forfeiture Endangers American Rights Foundation, I no longer give any free legal advice. Sorry but I've done my part.
