Q. Does each injured body part in a FL work comp have it's own 1-year statute of limitation for medical care?
A: The statute of limitations applies to the whole claim.
Q. Did my lawyer cheat me ?
A: Florida workers compensation law does not provide for pain and suffering. Settlement of a workers compensation matter is optional so neither party can be forced to settle. You indicated that your case was initially denied but then accepted after you hired a lawyer and she filed petitions on your behalf. I have very limited knowledge of your case but it seems like your lawyer is representing you appropriately.
Q. What event triggers wage reimbursement to begin in workers comp? Accident date, first doctors visit, or claim date?
A: If your disability lasts more than 21 days, lost wages are likely due from the date of accident. If your disability is less than 21 days, you are not entitled to the first week of lost wages. Your average weekly wage determines the amount of lost wage benefits you receive. The 80/80 formula is applied if you have a temporary partial disability. If you are uncertain about whether you've been paid correctly, I recommend you contact an attorney that specializes in workers' compensation matters. It will not cost you anything out of pocket as workers' compensation attorneys work on a contingency basis.
