Q. In Alabama does the county or city within that county have jurisdiction over someone accused of kidnapping.
A: In Alabama, Kidnapping is a felony offense. The State of Alabama prosecutes the case in the county for which the alleged conduct occurred. A municipal court does not have jurisdiction over felony offenses. However, you used the word kidnapping and did not provide any other facts, therefore, if the facts involved to not meet the requirements for kidnapping for instance when one parent keeps the child longer than their visitation is scheduled this would not necessarily amount to kidnapping and therefore would not necessarily rise to the level of prosecution for the criminal offense in the county in which it is alleged to have occurred. It could be that the domestic or family law court has jurisdiction for contempt of its prior order regarding visitation. So my answer is that depends. Q. can i record a conversation between me and one other person with out me telling her
A: In response to your question, I would need additional facts. Therefore, my response at this time is that depends on the state. Alabama is a one party state, which means that when one person in the conversation chooses to record the conversation, the other person is not required to be informed. There are some special circumstances that may require you to notify the other person there is a recording in progress. Therefore, before you do this you should come in for a consultation and discuss the situation and facts in detail.
Q. Separated since 4/17/23. I want to purchase a home without it seen as marital property. Divorce is Nov 5. Possible?
A: I would wait to purchase property until you receive the judgment of divorce. Matters of alimony and property division are interrelated, and the entire judgment must be considered in determining whether the trial court abused its discretion as to either of those issues. Willing v. Willing, 655 So.2d 1064 (Ala. Civ. App. 1995). Furthermore, a division of marital property in a divorce case does not have to be equal, only equitable, and a determination of what is equitable rests within the sound discretion of the trial court. Golden v. Golden, 681 So.2d 605 (Ala. Civ. App. 1996). In addition, the trial court can consider the conduct of the parties with regard to the breakdown of the marriage, even where the parties are divorced on the basis of incompatibility.
