Q. How does workers' compensation work?
A: For subscribers to the system, the Division of Workers' Compensation administer the adjudication of claims. They are a state agency that make decisions as to medical and financial benefits for injured workers.

It begins with a Benefit Review Conference where both parties provide evidence and attempt to informally resolve the issue. If it can not get worked out, it goes to a Contested Case Hearing. In the Contested Case Hearing evidence is entered in to the record and testimony may be taken. An administrative judge will give a written decision deciding the issues.

Q. Do you have to pay back workers comp if you get a settlement
A: It depends upon what you mean by settlement. If you receive short/long term disability disability, it will depend upon the policy. If you receive a settlement for a bad faith claim from you cause of action, you do not reimburse the insurance carrier.

However, if you are injured in your employment by the negligent act of a third party, your workers compensation insurance carrier my place a subrogation lien against your future entitlement to benefits and/or medical treatment.

If you are found entitled to social security disability or insurance, it will not affect your workers compensation. However, your workers compensation benefit may affect your social security benefit.
Q. Can you get fired wile you on workers comp
A: Yes you can get fired. However, the Texas Labor Code prohibits employers from discharging or discriminating against employees for filing a workers compensation claim, hiring a lawyer to represent them, instituting a proceeding or testifying in a workers compensation claim.

If the employer discriminates or discharges the employee for any of the above actions, the employee may get his position back and be entitled to damages.
