- Q. Charged with ownership of illegal pipe as passenger in Virginia
- A: Possession is the issue, not ownership. Two people can be in possession of something. Actual possession is when something is found on you whereas constructive possession is not on your person but generally nearby. They have to prove possession based on the facts... proximity, etc although proximity alone is not enough. So in a vehicle if it's found in the trunk that's harder to prove. Where it was, who it was closer to, who owned the vehicle... whether it was in plain view vs. concealed etc. those all play a role. You both would want to get lawyers to represent yourselves.
- Q. How to resolve jail release delay after false abuse accusation and charges?
- A: If he has a bond then they have to let you bond him out. It stinks that it's on the weekend and it's a holiday weekend. So the courts are closed.
I've had the jail blame the court before and say they don't have the proper paperwork from the court. If that's truly the issue that the court didn't send the proper paperwork then you're probably going to have to wait until the clerk's office is open again.
If the jail has the paperwork then I would go up the chain of authority with the jail. Hopefully he is able to get representation at some point because those are pretty serious charges but on the bond issue. All you can do on the weekend is essentially ... Read More
- Q. Arrested with spouse after undetermined aggressor, signed EPO, seeking case dismissal in Virginia.
- A: Generally domestic assault and battery cases are determined by what evidence there is and how the prosecutor decides to proceed. Any statements you and/or your husband made are admissible against yourselves. I had had cases where the other spouse doesn't want to proceed but the prosecutor still does. And I've had cases where neither party is willing to testify and the case gets dismissed. These are very fact intensive cases and it's best to have an attorney who can learn the evidence against you and properly advise you.
