About David A. WolfI am an attorney, author, and advocate. For the past 25 years, I have dedicated my practice to the representation of injury victims and their families. My clients have ranged in age from infants to one client who was 106 years old. Throughout the State of Florida, I have represented clients and guided them through the challenges of an injury case. From intake through conclusion, I am there for my clients. My firm's motto is On Your Side - At Your Side. This is a simple and powerful motto that puts the client first. I am the author of four books focusing on injury matters. The first book - The ABCs of Child Injury - Legal Rights of the Injured Child - What Every Parent Should Know - is a resource for parents and any other person in search of information and guidance regarding a child injury. The topics covered include Automobile Accidents, Playground Injuries, School Injuries, and other topics. I have been interviewed by local and national media including Time Magazine. Of course, the most rewarding part of my practice is making a difference for the injury victims and their victims. Again, the focus in On Your Side - At Your Side. My blogs have a wide variety of information regarding injury cases as well as safety tips. There are over 3,000 articles posted of original articles and content. As an advocate, I firmly believe in the rights of individuals and the responsibility of others to honor those rights. For instance, drivers should slow down in school zones. Day care providers should put down the mobile phones and concentrate on the supervision and safety of children. In the 3,000 articles posted and the four books written, there are thousands of safety tips and reminders. If followed, many accidents, incidents, and tragedies can certainly be prevented. Q. I was injured while working in my neighbors house.I was to be paid for my work.Must I show negligence on her part.
A: I do not believe that your neighbor would be subject to Florida's Worker's Compensation Laws. In order to collect money for the injuries, you typically would need to prove some fault on the part of the homeowner. It is possible that the neighbor has an insurance policy with Medical Payment coverage which may provide coverage for medical expenses only. Another attorney may have a different opinion or two on this matter.
Q. Can my mother be covered under my uninsured motorist coverage for bodily injuries if she was in a hit and run accident
A: You should review the UM insurance policy and read through the language as to the persons covered. An attorney in your area can assist you with this matter and the review of the policy.
Q. How many years are required to be vested in your marriage?
A: This is a very open ended and broad question. There are residency requirements for Florida law. There are also statutory factors that are considered for the award of alimony. Chapter 61 is the Florida Statute on point that covers these issues. Q. Does a criminal case need to be completed before starting a civil case?
A: Typically, an injury case (civil case) can be instituted before a criminal case is concluded. Depending on the case and the facts, some attorneys would recommend that the criminal case be concluded before starting the civil case in order to allow the facts and information to be developed by the prosecutors and law enforcement officials. Most injury attorneys offer a free consultation so it would make sense to consult with an attorney or two on this matter. I am working on a case right now in which I waited for the criminal investigation to be completed before starting the case. The report provided by law enforcement / State social services is very helpful to my case and provided some great facts and information for the case. Good luck with your case.
Q. Case Law, 1961-1964Wondered how I could check on past law cases.
A: Legal research can be done through services like Westlaw and Lexis. These companies require a subscription fee. Most court houses have a law library that is open to the public. You may also be able to access the law library at a local law school. You may want to put your search terms in Google for the subject matter and some websites may have case law referenced on the site.
Q. Ineed to make simple updates on my will
A: My firm can assist you with this matter or recommend an attorney closer to your residence. Hopefully, you have planned your Estate in a manner that would avoid the probate process and the need for directives from your Will. Of course, it is always advisable to have a Will in place but it is also advisable to set up your assets and affairs in a manner that avoids additional costs and delay for your chosen heirs and family members.
