Biography

Dave Maxfield has represented thousands consumers in personal and class action cases against banks, credit reporting agencies, and debt collectors. He obtained one of the highest verdicts on record against a furnisher in a a credit reporting case exclusive of fees, numerous large settlements, and in 2019 concluded a vehicle churning class action with total settlement value exceeding $21 million.

Dave is the 4-Time Chairman of the Consumer Law Section of the South Carolina Bar and Past President of the 1900-Member Richland County Bar Association. He serves as an Adjunct Professor at the University of South Carolina School of Law. Dave has also taught over 100 Continuing Legal Education (CLE) programs to other lawyers and speaks in the media and to law students on issues affecting consumers both locally and nationally.

In 2018, with co-author Larry Port, Dave wrote the ABA top-selling book, The Lean Law Firm, a manual for translating lean and agile methods into a simple, month-by-month template that law firms can use to become more profitable. Besides co-hosing The Lean Law Firm podcast, Dave consults with other law firms to help them transform their practices through Lean methods. Dave also consults with tech providers to make products more useful for lawyers, particularly in data visualization.

Q. I was sold a car that had a 125-point inspection, took it to a mechanic and there were issues that should've been found
A: Potentially; SC has a Motor Vehicle Dealer's Act, which prohibits deception in advertising or in statements made to you about the condition of the car. So, if Dealer said it had done an inspection (in advertising or elsewhere) but did not really do one, Dealer could be sued under the Dealer's Act.

Whether or not a case can be taken by a lawyer sometimes depends on how big the dealer is; smaller dealerships are sometimes difficult to pursue because of financial issues and the costs of recovery. However, all dealers in SC have to carry a 30k bond, so a complaint to the SCDMV may also be helpful, even against smaller dealers.
