David Kennedy Bifulco, Esquire. A graduate of Temple University School of Law. He started in the receivables management industry as an investment banker providing access to capital for debt buyers. He has headed the debt purchasing and collection operations for U.S. Asset in Fort Lauderdale, Florida and PFS Associates in New York and Pennsylvania.

Q. Estate property sole without executor consent for SIGNIFICANTLY Below market value
A: Dear Executor, without more details it is difficult to give you an answer as to what recourse you may have. That aside you are the Executor which means that you step into your Father's shoes regarding the disposition of his assets. The attorney that represented the Estate should have informed you of the sale. Unless you granted the attorney the power to dispose of the remaining PA assets at his discretion by granting him a Power of Attorney for that purpose. I would recommend that you gather all the documents that you have and meet with an Estate/Litigation Attorney as soon as possible. Please feel free to contact my office if you would like additional direction in this regard. I wish you all the best as you deal with this situation as I know it is difficult dealing with the loss of a loved one and resolving their affairs after they pass.
Q. I received a call from a courier saying that i had certified mail from someone and gave me a phone # and case ID #. So,
A: Barry is correct. Sounds like a scam. The Statute of Limitations for debt collection cases is normally 4 years, unless the instrument (usually a mortgage note), is signed under seal and then the Statute of Limitations is 20 years
Q. if a home had a heloc loan on it from 03, and was never paid and the deed was given to me can the 3rd party foreclose?
A: Without more information I can't give you a complete answer. There are several options depending on what the documents say. You should contact an experienced Real Estate/Foreclosure attorney to go over the documents and provide you with possible solutions.
