Doug Goyen graduated from Southern Methodist University School of Law in 1997. He attended high school in Dallas, Texas, and graduated from Bryan Adams High School in 1986. Prior to attending Law School, Doug Goyen worked at GEICO as a bodily injury claims adjuster, giving him valuable experience in dealing with insurance companies.

A: 1. First, it does not matter who was at fault in an auto accident, you are entitled to get the identification and insurance information of any other drivers involved in your auto accident. The law in Texas is that drivers are required to exchange this information - regardless of who the police feel who is at fault. See Texas Transp Code:

Texas Transportation Code Sec. 550.023. DUTY TO GIVE INFORMATION AND RENDER AID. The operator of a vehicle involved in an accident resulting in the injury or death of a person or damage to a vehicle that is driven or attended by a person shall:

(1) give the operator's name and address, the registration number of the vehicle the operator was driving, and the name of the operator's motor vehicle liability insurer to any person injured or the operator or occupant of or person attending a vehicle involved in the collision;

(2) if requested and available, show the operator's driver's license to a person described by Subdivision (1) . . .

2. You should contact a personal injury lawyer in your area to talk to them about liability issues - the issues you describe place you in a difficult situation that is hard to win - failure to yield is easier to prove than speed without eye witnesses or video helping you out.

Q. I got into an accident and the other driver took my license is that legal
A: If they physically kept your drivers license and did not give it back, then no - they should not keep your license. Both parties involved in an auto accident are required to exchange their identification information and insurance information - regardless of who is "at fault".

Texas Transportation Code 550.023 states:

DUTY TO GIVE INFORMATION AND RENDER AID. The operator of a vehicle involved in an accident resulting in the injury or death of a person or damage to a vehicle that is driven or attended by a person shall:

(1) give the operator's name and address, the registration number of the vehicle the operator was driving, and the name of the operator's motor vehicle liability insurer to any person injured or the operator or occupant of or person attending a vehicle involved in the collision;

(2) if requested and available, show the operator's driver's license to a person described by Subdivision (1); and

(3) provide any person injured in the accident reasonable assistance, including transporting or making arrangements for transporting the person to a physician or hospital for medical treatment if it is apparent that treatment is necessary, or if the injured person requests the transportation.

Q. How do I answer a lawsuit? I am being sued for an accident but my insurance company has settled with the plaintiff.
A: I would notify your insurance company. They have a duty to defend and a duty to indemnify. If they settled with the person who is suing you, they should have a release for you - hopefully.

If you are being sued by another person involved in the accident (such as a passenger) then your insurance company should hire a lawyer to defend you in that case.

Contact your insurance company and let them know about the lawsuit.
