At the Justice Department, Eva handled cases brought by whistleblowers in federal district courts throughout the United States, with more than $500 million in False Claims Act recoveries: violations of the Anti-Kickback Statute and Stark Law and all federal health care programs (Medicare, Medicaid, TRICARE, FEHB). Her settlements include:
•$300M (drug company/illegally marketed drugs not approved by FDA/high pressure sales tactics/paid physicians’ cash, consulting fees, meals, lavish entertainment)
•$45M (pharma manufacturer off-label marketed drug with dangerous side effects)
•$38M (drug company paid physicians to write prescriptions for patients with heart conditions, fibromyalgia, or dementia)
•$35M (drug company misled patients/physicians about intended uses of a drug)
•$26M (managed care Medicaid contractor failed to provide screening, assessment and case management for adults/children with special health care needs)
•$20M (oncology provider billed for medically unnecessary and paid doctors’ bonuses to order these tests)
•$12M (cancer center billed for radiation oncology services not medically necessary, and patients not properly supervised by doctors)
•$8M (radiology center gave patients intravenous chemical during MRI scans without proper physician supervision and paid doctors kickbacks for referring patients)
•$7M (hospital submitted Medicare claims for fraudulent oncology services)
•$Millions (physician practice group performed unnecessary, but highly invasive peripheral artery procedures on patients) • (hospice companies prevented Medicare patients from receiving curative care) • (medical center fraudulently administered intensity modulated radiation therapy, IMRT) • (defense contractor charged unallowable costs on an army contract) • (fraud in the contracting process involving GSA and the U.S. Small Business Administration, SBA)
