I am 100% committed to my clients. I give my clients personal attention and have done so for more than 45 years in Virginia. As an attorney in a well established Alexandria City law firm, I provide my clients with legal services and skills at a high quality level and at reasonable hourly rates in Northern Virginia, including Fairfax County. I work with individuals, as well as small and large businesses, which are foreign and domestic. I handle mostly residential and commercial landlord-tenant disputes and leases. However, I advise clients who are consumers and professionals on a range of issues, specifically, fair business practices, business contract disputes, landlord and tenant law, residential real estate matters, loan documentation, commercial leases, business acquisitions, estate planning and serving as general civil litigation counsel. I have an AV rating with Martindale-Hubbell that is the highest rating regarding competence and ethics for lawyers. I accept cases on an hourly billing basis. I do not take cases on a contingency fee basis. I served in the U.S. Marine Corps and am happy to provide professional legal advice to all current and retired military personnel in the metropolitan Washington, DC region. Q. If I have text messages from the landlord saying the house was ready but when I moved in the septic tank was no good
A: In Virginia, if the County has condemned the premises, you must leave the premises. As for the reimbursement of the expenses, you will have to make a claim in the Court in the jurisdiction in which the premises is located and seek a judgment against the other party. You will have the burden of proof to prove by a preponderance of the evidence that your claim is correct.
Q. Can my landlord change previously agreed upon written rental price and terms after they notified me initially by mail?
A: In Virginia, one party to a written residential lease for a specific Term cannot unilaterally change the terms of the lease unless the other party to the lease agrees to the changes in a written document. Based on your reported facts, it appears that the landlord is attempting to change the provisions of the lease and attempting to make you agree to the changes. If you do not agree to the proposed changes and those changes are not reduces to a written agreement, the written residential lease cannot be changed or modified.
Q. Who decides if who is responsible for the atty fee if I sign the lease the judge or landlord
A: In Virginia, only a judge has the authority and the power to award attorney's fees that would be made part of an Order and/or a Judgment.
