Prior to opening Ryan Law Firm, I operated the firm of Ryan & Golden with my former partner (now Lowndes County State Court judge) Hon. Ellen S. Golden. Previously, I worked for many years for larger litigation firms. Early in my career, I had the privilege of working as a law clerk for Hon. Hugh Stone (ret.) and Hon. David Barrett (ret.) in the Enotah Judicial Circuit of Georgia, and as an assistant district attorney in the Enotah Circuit. I live in Lowndes County, Georgia with my wife Emily and three children, Mattie, Wheeler and Sara Haynes.

- Q. In a worker's comp case the insurance company says that I must pay for the medical clearance for my surgery. Is this tru
- A: Generally, the insurer is required to pay for reasonable and necessary treatment for the work injury, if provided by an authorized treating physician or an authorized referral. Your medical clearance may or may not be covered based on the specific circumstances of your case. I agree that it is best if you consult with an attorney. - Q. My classroom is making me sick for the odor that triggers my asthma. Can I file workman's comp?
- A: Many more details would have to be known in order to know if you might have a compensable workers' compensation claim. However, in general, an aggravation of asthma may be covered by workers' compensation. There is a 2008 case from the Georgia Court of Appeals where a bus driver's asthma injury caused by inhalation of fumes while cleaning her bus was covered. Again, more would have to be known about the specific circumstances of your case.

- A: You may have a claim against the driver of the other car. Of course, more would have to be known about the specific facts of your situation. However, the mere fact that your children were not in a car seat (although they certainly should have been) would not prevent you from making a claim against the other driver.
