Contingent Fees
Consistent with Florida law of one third of amounts when we settle before a lawsuit is filed or 40% thereafter.. We also share our attorneys fees with qualify co-counsel consistent with Florida law, and assist foreign counsel with appearances Pro haec Vice, to allow appropriate division of fees, and obtain court approval for qualified out-of-state attorneys. -
Rates, Retainers and Additional Information
$550 per hour, mixed contingent and hourly rates with retainers negotiable. 25% referral and co-counsel fees promptly paid.

- A: I agree with both of my colleagues answer. In order to establish a case for negligence against the vendor of an expired drug, you would have to be able to establish that there was a causal link between the medication and the harm caused to your child. Only a doctor can tell you if the pneumonia may have been caused by an expired medication, however, that sounds unlikely. Until you can establish that link, you cannot establish a viable case for negligence, resulting in damages. I hope your child recovers quickly without any further consequence.

In fact, there is a legal doctrine called "Res Ipsa Loquitur", essentially means the thing speaks for itself. In order to determine whether you have a viable case, you will need to speak to a qualified product liability lawyer in your area. However, any lawyer will want you to save the package, medically document the injury (i.e., make an appointment with your primary care doctor and/or a dermatologist or other doctor qualified to treat whatever the medical condition is) and take photographs until you get to the lawyer and or Dr. to show the development of the wound.
