- Q. I was at fault for an accident and I’m having awful anxiety about being sued, it seemed minor at the time.
- A: Being sued is certainly stressful, yet most of the time, needlessly. If this claim stems from an auto accident, contact your insurance company and let them handle the case and worry about it. If you have coverage, the insurance company will provide a qualified attorney to handle the matter. The attorney, the company, assigns you will answer your questions and inform you of his defense of you in the lawsuit. Statistics show that about 90% of all personal injury cases in Texas get settled before a jury trial.
- Q. If pain and suffering, injuries etc exceed the policy limit of the at fault persons insurance. What can I do?
- A: Generally, the insurance carrier for the negligent party will only pay up to their policy limits on a claim. If you have underinsured motorist coverage on your auto policy, that policy can provide coverage on top of the limits from the adverse insurer. There are certain very limited circumstances where one may collect more than the primary limits from the other party's insurer if the insurance company should have and could have settled the case within the limits but failed to do so. This situation is known as a "Stowers demand" and is complex and would require assistance from a personal injury attorney.
- Q. Would I be able to sue for wrongful death? My mother was the passenger in a car accident.
- A: I am sorry for your loss. The law in Texas allows parents, children and spouses to bring a wrongful death claim for the loss of the family member.
