Mr. Greer is expert in real estate and construction law for the past 35 years: whether involving consultation, dispute management, transactional matters, arbitrations, or trial, he has successfully served real estate and construction clientele (large and small) in all of their "phases" of need in California and Colorado. He is an extensivley experienced Attorney, a certified Arbitrator (i.e. private Judge), and a licensed General Contractor. Mr. Greer offers transactional work and consulting in real estate purchase/sale contracts, leases, and construction contracts; and he offers experienced guidance in any type of real estate matter from procurement thru development. His practice in the construction industry includes advising contractors, developers, design professionals, and owners. He serves clientele in the real estate industry by assisting buyers/sellers, lessors/lessees, brokers/agents, and mortgage brokers. He accepts appointment as an Arbitrator in construction and realty matters. And, Mr. Greer can be hired as an advocate in select litigation matters on a case-by-case basis on behalf of these same clientele and same types of subject matters (i.e. selective litigation matters as he has limited the number and extent of his litigation practice).

A: Dear FAILURE TO DISCLOSE claimant: The type of lawyer you need is a real estate and construction experienced lawyer. And, no, you shouldn't expect to have to hire separate counsel for your claim of (1) Failure to Disclose, and (2) Negligent Inspection. I am hopeful that you have a standard Colorado Purchase And Sale Agreement whereby your remedy against the Seller is to first pursue Mediation (look for Section 23). Additionally, you should examine the terms of your Inspection Agreement whereby most contain limitations of liability clauses, unfortunately. Best wishes on your pursuit. JAMES GREER
Q. What is the price range for an attorney letter
A: Attorney Letter: The "price range" is dependent upon: (1) how many documents/emails/photos/invoices/back-charges/contracts and subcontracts/discussions are implicit in the task, and (2) is the client intending the attorney "ghost write" the letter as compared with the attorney becoming "of record". Most attorneys will analyze the client's replies to these two questions (for free), and then offer a Flat Fee to accomplish the task of drafting the legal demand letter. My experience, after 35 years of practice and related experience in performing a LOT of demand stage correspondence, is that the range is usually between $400.00 and $500.00, so long as the client is not asking for additional tasking thereafter as part of that Flat Fee. Q. When we purchased our home, we understood that there was a driveway easement, which provides us access to our property.
A: Dear Driveway Easement Owner: When an ingress/egress easement serves several properties the standard mechanism for maintaining the shared driveway is something called a "Maintenance Agreement". Typically this type of agreement requires a pro-rata contribution (based on percentage of road use or frontage) for the yearly division of the costs to maintain. You should begin by asking all appurtenant owners whether or not there is such an Agreement in place. If there's not, I'd suggest calling for a meeting of all users of the easement and try and work out an agreement. JAMES GREER
