James Tupitza
I have been a real estate, business and trial lawyer since 1976. The firm handles real estate transactions from purchases of home to large commercial property. We handle zoning and subdivision and litigation. Our pipeline team aids landowners when pipeline companies want to acquire or expand easements.
We handle construction and other real estate litigation. Stucco has been a big issue in recent years.
We have a related title insurance agency which enables us to reduce our fees to real estate buyers and people refinancing.
I am the course planner and lead instructor for a series of continuing education courses offered by the PA Bar Institute. They are: a)Boundary Law in Pennsylvania, a course on paper streets. landlocked properties, boundary disputes, tree issues and survey issues; b) Who's On First: Lien Priority in PA, a course on figuring out who has the right to sell a property at sheriff's sale and who gets the money generated; and c) What's on Second, Advanced Lien Priority and Lien Divestiture, an advanced version of Who's on First.
Each year I speak a the Real Estate Institute, held early in December at the Philadelphia Convention Center. In addition to this I regularly teach continuing education courses to real estate licensees.
Trial experience includes partition, business disputes, failure to disclose, construction disputes, disputes with home builders,zoning issues and more. I have handled appeals to the U.S. Court of Appeals, the PA Superior Court, the PA Commonwealth Court and the PA Supreme Court.
