Jason Horst is the Managing Partner of Horst Legal Counsel. Jason served for more than a decade as an attorney in large regional and international law firms before founding Horst Legal Counsel, serving the legal needs of businesses and individuals in California.
Jason is an accomplished litigator, having successfully resolved countless disputes for his clients in a wide range of complex litigation matters, including those involving commercial contracts, partnership disputes, trademark infringement, real estate, antitrust, and more. Jason prides himself on the ability to develop and execute creative strategies to efficiently accomplish his clients’ goals.
Jason is also among the foremost experts on the intersection of insurance law and the cannabis industry. Jason offers a range of risk management services to clients in and servicing the cannabis industry, including counseling related to insurance placement, risk transfer strategies, and preparing insurance specifications. Jason counsels clients regarding how to effectively transfer their business risks, allowing them to focus on running and growing their businesses sustainably.

- Q. Can any lawyer within a firm issue a deposition subpoena or only the attorney on record (listed on the court register)?
- A: Generally, any attorney in the firm of record can issue a subpoena. It is not unusual, especially with larger firms, for attorneys whose names do not appear on the court’s list of counsel to work on a matter and send out correspondence and discovery requests, including third party subpoenas.
- Q. How do I know a summons is legit and not a scare tactic from the other party’s attorney?
- A: See if there is a file stamp in the box at the top right. If so, the complaint and summons have been filed and it’s a real lawsuit. Doesn’t necessarily mean the other side wants to take the case all the way to trial, but it certainly suggests that they are serious about pursuing the litigation.
