- A: In Virginia, it is a criminal offense for a person to photograph or video a person when they are nude or in a state of undress without their consent. Likewise, it is a separate criminal offense to disseminate those images or videos without the person's consent.
Based on your question, it appears that the person who video taped you without your consent violated Section 18.2-381.1 of the Virginia Code. If they have shared the video, they likely also violated Section 18.2-386.2 of the Virginia Code.
