- Q. My daughter was clipped by a plow on Saturday night and is traumatized by the incident. Do I have a case?
- A: Your daughter may have a viable claim against the driver and owner of the vehicle/ driver's employer for negligent driving resulting in personal injuries. You do not say how old your daughter is. If she is 18 or older, she can legally bring her own claim. If she is under 18, her parent may bring the claim. I have handled a number of these snow plow types of cases, and the driver and owner of the plow will have an insurance company handling this for them. They will do everything to blame your daughter and avoid paying the claim. You should take a lot of photographs of any visible injuries she has as soon as possible. - A: I am sorry for your terrible situation. I assume this abuse happened while you were age 18 or over. Unfortunately, I believe the statute of limitations would bar any claims you may have. Typically, you have three years from the time of the incident to bring a lawsuit. The time has likely passed allowing you to bring a claim since this occurred about 7 years ago. There are some exceptions to this. I am curious as to whether you filed any police reports in 2012 and why you have waited this long to consider this. You can certainly try to file a report with the local police. However, given the delay, this may not receive the attention it otherwise would if filed close in time to the incidents. ... Read More
