Biography

Attorney Kevin Ryan has practiced in the area of consumer and business bankruptcy law for more than 20 years. He worked his way through the College of Wooster, in Wooster Ohio while employed in the evenings. He was a four (4) year letterman and three (3) year starter on the College of Wooster football team and was a member of the NCAC All Conference Team (1992) and All Academic Team ( 1991-1992).

After college, Attorney Ryan attended evening law school at The Cleveland Marshall College of Law while working full time as a paralegal. He started his law career as a trial attorney for the Cuyahoga County Public Defender and then opened a private law practice handling mostly bankruptcy cases. In more than 23 years Attorney Ryan has directly handled several thousand consumer and small business bankruptcy cases, and a broad range of other civil cases.

Attorney Ryan has practiced in the areas of criminal law, family law, probate law, real estate law, civil and criminal appeals, personal injury law and business litigation. Attorney Ryan has handled jury trials, depositions, bench trials, mediations, federal and state appeals, and administrative hearings. He brings a broad perspective and life experience to the table and gives personal attention to every case he takes on. He now focuses his practice on bankruptcy , asset protection, real estate (state licensed real estate sales agent) , and probate / estate matters.

A: The bankruptcy code requires a disclosure in the Statement of Financial Affairs of any assets transferred to a Trust within 10 years of the filing date for the case. I am not sure why the lawyer advised you to do this, because they can still be considered an asset of the bankruptcy estate. Also, if the laywer advised you to do this and file a Ch 7 bankruptcy case, this could be considered advice that was well below a reasonable standard of care. It would require an expert opinion in order to determine if actionable legal malpractice was committed. Time is of the essence because there is a statute of limitations in most cases of

A: A Living Trust would be one of the best simple ways for your father to set up his estate plan. The real estate would need to be transferred to the Trust and the documents would most certainly need to be prepared by an attorney. An Attorney who practices in the area of estate planning and tax law can also advise you as to whether your father's estate is under the applicable federal and state estate tax thresholds, which may require a more complex estate plan.
Q. Can I press charges for my husband using my SSN for taxes after separation?
A: You should first go to www.irs.gov and get a transcript of the tax return for the year in question. Next, contact the IRS and schedule an appointment at the Taxpayer Customer Service office closest to your residence, and ask a representative to review the situation. Each individual person has the right to decide between any available legal options for tax status on a particular year's tax return. Your husband is not legally permitted to sign your name to a federal tax return without a signed IRS Power of Attorney or Power of Attorney drafted and signed by you in accordance with the laws of your state.
