Q. Can you sue for Malpractice after being left to birth in a toilet at a hospital?
A: I am so sorry this happened.

I am so glad you and your baby are ok.

No, you don't have a viable malpractice claim. I would recommend sending a letter to the hospital and let them know how upsetting this was - but beyond that, you do not have a compensable claim under Virginia law that we would recommend pursuing. The costs of litigation would far exceed any recovery.

I am so sorry as I know this was stressful and made delivery even more difficult. However, it is not a viable lawsuit.

Q. My brother died in Virginia . I live in Texas and am named in his will as executor. Can I sign a proxy to an attorney.
A: Who does the Will appoint as Executor?

You can contest that appointment and should hire an attorney in the town / county where he lived - but usually, whoever the Will appoints is allowed to to qualify.

Also, Virginia does have a statute that if you cause someone's death you can't profit from their death. So if he is found guilty he won't likely receive any inheritance.

Bottom line - you'll need an Estates Attorney where he lived.
