Lyndsie Nichole Russell

Ms. Russell was raised in Northern California and attended California State University, Fresno as a member of the Smittcamp Family Honors College. She competed for four years as a member of the Fresno State Mock Trial team, completing over one hundred trials and winning numerous awards for her performance as a student attorney and witness. She graduated in 2012 with her Bachelor of Arts in Political Science, cum laude, and her Bachelor of Science in Criminology, cum laude and with department honors. She received her juris doctor degree from the University of Southern California, Gould School of Law in 2015.
During law school, Ms. Russell served as a small claims and civil harassment mediator, member of the school’s Mediation Clinic and Jessup Moot Court Team, and Justice of the school’s Phi Alpha Delta chapter. She also worked at a law firm, specializing in plaintiff’s products liability claims.
Ms. Russell currently serves on the board of the Fresno County Bar Association and Central Valley Trial Lawyer’s Association. She previously served on the board of the Fresno County Young Lawyer’s Association and was president in 2021. Ms. Russell is an adjunct professor at Fresno City College.
Ms. Russell is additionally the co-host of a podcast, A Place in the Courtroom, which focuses on true crime, civil cases, and all things legal.
Ms. Russell is a current board member of Resiliency Center and is an alumni member of Philanthropy Inspired by the Needs of Our Community (PINC). She previously served as service chair, event chair, and president of PINC.
In her spare time, Ms. Russell enjoys reading, volunteering, and spending time with her husband, two dogs, and cat.

- Q. Is a two year non elective surgical postponement grounds for a medical malpractice lawsuit for a SSDI senior.
- A: There are not enough facts listed to determine if this is a viable medical malpractice case. The torn right patellar tendon needs to be the result of malpractice or the breach of standard of care. Another medical provider would need to have the opinion that it is malpractice before the lawsuit could be successful. As Eliza Jasinska said, there are time limits on when a malpractice suit can be filed. This really does need to be discussed with an experienced malpractice attorney. You may need to look outside of your city to find an attorney willing to take your case or speak with you.
- Q. Can I talk to the defendant directly and agree on a settlement to get payment? And how?
- A: You will likely need to get in contact with the defendant's attorney. While the defendant is the individual who hit you, usually he/she will be represented by an attorney that works for the insurance company. If your attorney has substituted out of the case and you are now listed as representing yourself, you can contact the other attorney. If your attorney is still counsel of record in the case, the defense attorney will not talk to you directly until a substitution of attorney is filed listing you as pro per (i.e., representing yourself).

- A: If you have been served with the complaint, you should hire an attorney immediately. There is a limited time for you to respond to the complaint. If you do not respond within the timeframe, a default can be taken against you which cuts off your ability to defend the lawsuit. An experienced attorney can help you fight the defamation allegation, any privileges that apply for reporting a crime, and advise you on reporting the rape to law enforcement.
