Biography
I have been a practicing attorney for 25 years. Having been licensed to practice law in NJ, PA, Ohio and GA, I focus my law practice on Criminal Defense, which includes everything from traffic tickets to murder. I enjoy helping people who come to me in need of assistance at what, for many of them, is truly the worst possible time in their lives. I believe each and everyone of us is entitled to the best possible legal defense and it is my goal to provide that to all of my clients. It may be old-fashioned, but I strive to treat everyone I meet with kindness and respect and, in a nutshell, to treat people as I would like to be treated.

- Q. (Subpoena for Attendance of Witnesses) 1) Can you decline a subpoena in Georgia? 2) Can you testify in secret?
- A: No, you cannot disregard a subpoena. The court can and will hold a witness in contempt for violating a court order or subpoena to attend.
Also, pursuant to the Constitution, a defendant has the right confront or to look a testifying witness in the eye and cross exam him or her, so no you may not testify in secret. There is one caveat, however, witnesses who testify before a grand jury do so in a closed hearing which means the defendant and his attorney shall not be present. Grand jury proceedings are also closed to the public.
- Q. How likely is the defendant to get Probation?
- A: In order to completely answer this question, I would need to know exactly what the charges are. However, I can tell you that there are mandatory minimum terms of incarceration for certain types of aggravated assault. That means , he would not be eligible for probation if convicted.
For example if he were convicted for violating O.C.G.A. 16-5-21(c)(3)(I), where the “offense is committed between parents of the same child”, then the punishment shall be no less than 3, but no more than 20 years incarceration.
- Q. Can you get a dui if you’re in your house and there is no proof of your driving the car under the influence
- A: Although you maybe charged on a DUI based on circumstantial evidence and perhaps eyewitness testimony, you may have defenses to help avoid an actual conviction.
Without knowing all the facts, I can not say definitively whether this is true in your particular case.
