Attorney Matthew M. Breen is the managing partner of Lowcountry Law, LLC, which has law offices in Mount Pleasant and Myrtle Beach, South Carolina. Q. What is the statute of limitations ?
A: Generally, statutes of limitation (deadlines for filing a lawsuit) in South Carolina are three (3) years from the date of when the injury or occurrence that would give rise to the lawsuit happen. If a governmental entity is the intended Defendant, the Tort Claims Act comes into play. It has SECTION 15-78-110. Statute of limitations.

"Except as provided for in Section 15-3-40, any action brought pursuant to this chapter is forever barred unless an action is commenced within TWO YEARS years after the date the loss was or should have been discovered; provided, that if the claimant first filed a claim pursuant to this chapter then the action for damages based upon the same occurrence is forever barred unless the action is commenced within three years of the date the loss was or should have been discovered."
