Biography
Florida Probate Attorney: Though my practice areas include estate planning and real estate work, my practice has become largely focused on Florida Probate cases. Prior to opening my doors in the greater Orlando area, I was associate counsel at Rarick & Associates, P.A., the leading estate planning firm in Miami Lakes, Florida. I also clerked for Becker & Poliakoff, P.A. in Ft. Lauderdale. When I can get away from the office, I am a proud internet geek, Florida Gator fan, husband and father.

- Q. My dad has passed his will mistakenly states that he is a single man but he is married we live in FL is the Will valid.
- A: The Will may be valid but his actual spouse may have a stake in his estate as well. You should contact local counsel to present the Will and explore options.
- Q. Can I transfer a car title with no probate done?
- A: If it’s clear to the DMV who the heir should be and the car does not have a lien on it, then you have about a 90% chance that the DMV will authorize the transfer without probate orders. It’s always worth trying - worst they can say is no.
- Q. My mom died 15 yrs ago. Fltreasurehunt shows an account. No probate was opened. Do we need one now?
- A: The Bureau of Unclaimed Property (who administers Fl Treasure Hunt) may have a threshhold amount (possibly as high as 10k) before probate is required. Call ahead and find out if probate would be absolutely required. Otherwise, you'd likely need probate.
