Biography

Mr. Middlebrook is a Southern California Super Lawyer, is AV Rated (highest rating available by Martindale Hubbell) and has a perfect 10 rating on AVVO.com. He is considered the preeminent DUI attorney in the Southern San Joaquin Valley. He spends hundreds of hours a year attending, moderating and lecturing in seminars. He exclusively represents persons accused of driving under the influence of alcohol and drugs and the forensic science associated with those areas. He is a Founding Member of the DUI Defense Lawyers Association and currently sits on their Second Vice President. He is a Sustaining Member of the National College for DUI Defense. He is a graduate of multiple summer sessions of the National College of DUI Defense held at Harvard University in Cambridge, Massachusetts and Winter Sessions held worldwide. He is trained as an Instructor in the administration of Standardized Field Sobriety Testing through the National Highway Traffic Safety Administration and is a regular attendee at Mastering Scientific Evidence Seminars. He is an full member of the American Academy of Forensic Science and the American Chemical Society. He is one of only six lawyers in the State of California and less than 50 worldwide to be designated by the American Chemical Society as a Lawyer-Scientist. The ACS-CHAL Forensic Lawyer-Scientist is one who uses validated and legitimate science for the benefit of justice. These are lawyers who study the science and apply it legitimately in the courtroom. They expose invalid or non-validated science and use valid science in the courtroom. They eschew the smoke and mirrors techniques of old and embrace the science for the benefit of all. He has tried over 230 DUI cases throughout his career with a 97% success rate. He has acted as lead counsel in over seven thousand administrative hearings, writ proceedings, motions, and appeals. His success rate in those proceedings is unmatched anywhere in the Southern San Joaquin Valley.

Q. If someone had a DUI in another state, and then gets another DUI in California, what would most likely happen?
A: Generally, a DUI within 10 years anywhere in the United States is chargeable as a prior so long as the law in California is substantially similar to the state of conviction. California is a “movement” state requiring a vehicle be moved to meet the driving requirement. Some states, are control states meaning you only need to be in control of the vehicle. If the laws are different it is not priorable in California.
Q. I was arrested for a DUI in California on July 4th and DMV is still not showing my arrest/suspension.
A: First, you are not in suspension based on the arrest. Your DUI Suspension begins on the 31st day after the arrest so your legal to drive. It will show up when it goes into suspension. If you want an immediate restriction, and this is a first, get the IID installed, sign up for the alcohol education program, file the sr-22 for insurance purposes then go to the local dmv to request the restricted license. You’ll have to pay their fees too.
Q. Can a lawyer get my hospital and morgue class dismissed since they were delayed and I'm now out of state due to COVID19?
A: Yes. You may make a motion to the court to modify your sentence.
