- A: You should have the actual language reviewed by an attorney. Most employment is "employment at will" even if there are certain terms agreed upon. In an employment at will situation, either you can quit and the employer can fire you at any time for any reason except for a short list of illegal reasons (discrimination on basis of age, gender, race..., etc). If there is an employee handbook, there might be an implied contract. - Q. Does the small estate Affidavit have to be notarized or filed at the court house to be valid?
- A: The small estate affidavit does not have to be notarized. It does need to be signed "under penalty of perjury."
As far as whether you need to file it at the courthouse, it depends on what you want to use it for. Most of the time, you simply provide it to whatever institution you are dealing with (often a bank).
