Neil Sullenberger

Neil is a relentless litigator who has proven himself time and time again before courts and juries alike. He utilizes a pragmatic, common sense approach to cases to ensure his clients end up in the best possible financial position. He seeks to avoid expanding litigation unnecessarily, streamlines all of his cases, and tries only the operative claims to avoid additional expenses to the client.

Neil is originally from Pittsburgh, PA. He finds that his blue collar upbringing is an asset and clear advantage over his competition. He earned his Juris Doctor with two academic emphases in corporate and commercial law from Michigan State University College of Law. While in East Lansing, he was a member of the Michigan State Law Review and a clinician for the Albin L. Storrs Tax Clinic as well as Michigan State's Small Business and Nonprofit Clinic. His undergraduate degree is from Washington & Jefferson College, a small school just south of Pittsburgh. At W&J, he earned a B.A. in Economics, with an emphasis in Financial Economics and a minor in Mathematics.

Neil utilizes his tailored training in corporate law, commercial law, and finance to competently advise the firm's clients in various types of business disputes. His background affords him a unique ability to advise clients about often unforeseen consequences of their decisions from both a legal and business standpoint.

Neil litigates in all of the firm's practice areas, focusing mainly on business disputes and construction defect cases. In his spare time, he enjoys skiing, hunting, fishing, camping and playing sports in a few of Denver's intramural leagues.

Q. Is the home contractor who built a retaining wall responsible for repairs in Colorado for new home?

A: I'd need a bit more information than what's here, but with new construction in particular, this issue would typically be covered by an express warranty if construction was completed, or potentially punch list if construction is just finishing. Absent an express warranty, or if it existed and expired, contractors still have the general obligation to perform their work in workmanlike condition. It's also not clear if you're talking about repairs to the retaining wall itself, or resultant damage to the home.
