Nelson is from Arab, Alabama, where he grew up working with his Father and Grandfather on their small cattle farm. He is no stranger to hard work and will put that work ethic to good use when working on your case.

Nelson graduated with special honors in his major from Jacksonville State University, where he earned his Bachelors of Science in Criminal Justice. Nelson went Graduated in the top third of his class at Cumberland School of Law, Samford University. While at Cumberland, Nelson served as the President of the Federalist Society, a Senior Member of the Trial Board, competed as a member of the Cumberland Mediation Team, and made Dean’s List every semester. Nelson has been admitted to practice law in Alabama, Georgia, and the Federal District Court in the Northern District of Alabama.

Q. Can I be charged for more expensive replacements than what I damaged
A: Without more information this question is going to be difficult to answer accurately.

The general purpose of civil law is to place people back in the position they would have been in had the tortious act not occurred. Compensatory damages are designed to compensate the person for their loss. With that in mind the recovery should be the cost to replace what was damaged or to restore the damaged item back to its previous condition.

You should consult with an attorney in your area and provide him the full details of the situation for a more complete answer.
Q. Do i have to divulge my settlement amt from @fault insurer to MY” insurance Co. Before my underinsured claim is paid?
A: Your uninsured/underinsured motorist coverage takes effect only after the insurance of the tortfeasor (at fault party) is exhausted. To confirm that you would need to advise your insurance company of the insurance limits for the tortfeasor and the amount of the settlement. You will need to have them consent to the settlement with the tortfeasor before accepting those funds. The UM insurance provider has the option to front the tortfeasors' limits in order to keep them as the defendant in the case. They may do this if they think the tortfeasor is a particularly good defendant. (i.e. sweet old elderly woman who they think a jury is unlikely to award a large judgment against) If you have received med pay coverage from your insurance you will also want to ask for a waiver of the med pay subrogation.

Q. If your being arrested does the officer have the right to tow your vehicle
A: If you are arrested while operating a vehicle the officer does have the option to tow your vehicle. If you have a passenger that is not being arrested the officer has the option to allow that person to take the vehicle for you if you consent.

Similarly, if you are arrested on someone else's property and your vehicle is on their property as well, they can request that the officer remove the vehicle from their property.

You should also be aware that you will be responsible for any tow fees or storage fees that result from the arrest. If you are going to be remaining in jail for an extended period of time and are unable to retrieve the vehicle yourself, you should have someone go and pick up the vehicle for you to avoid having daily storage fees pile up on you.

If it was an improper arrest that would make the decision to tow the vehicle improper as well. If you believe you have been unlawfully arrested you should contact a criminal defense attorney in your area to discuss the facts and circumstances of your arrest.
