Legal Answers
- Q. How can I request to be reimbursed from a contractor on a plumbing job done incorrectly?
- A: A homeowner may file a complaint against a contractor who performed work on their home. A complaint can also be filed against those professionals the CRLB licenses. Complaints cannot be filed on work conducted on commercial properties. The list of contractors includes, but is not limited to carpenters, siding installers, roofers, foundation installers, drywall installers, plasterers, insulation installers, ceramic tile installers, floor covering installers, swimming pool installers, masons, painters, chimney installers and fireplace installers. Subcontractors and contractors may also file complaints against each other so long as the complainant is registered with the SBO. To file a complaint against plumbers and irrigators, electricians, alarm businesses, telecommunications, hoisting engineers, and mechanical contractors, please contact the RI Department of Labor and Training. https://crb.ri.gov/consumer/complaint-filing-overview has instructions to help with your contractor dispute in Rhode Island. Consider contacting and engaging a practicing attorney to help you prepare, present, and press your case in court, if necessary.
- Q. Is there a good chance that I can qualify for accelerated rehabilitation it being my first offense?
- A: "what I'm being told ..." Hopefully, you are being guided, informed, and represented by a licensed attorney who is helping you topprepare and defend the case. Part of that advice will likley include NOT making ANY statements in public (forum like this) to preserve your constitutional rights. If you do not have an attorney representing you, correct that soonest for best chances of afavorable outcome in your case.
- Q. When my case is over, can I ask for my entire file from my attorney and what are they allowed to charge?
- A: Your retainer agreement signed with the attorney addresses the contractual obligation and fee agreement & charges that are "reasonable" according to professional standards. You may request your file at any time. Note that the court also retains copies of all documents filed there for three years. After that they transfer to the Judicial Records Center.
