Q. Do I need to disclose my arrest before having a background check in California to a new emploer
A: Generally speaking, I wouldn’t disclose an “arrest” unless I was specifically told to do so. Arrests are highly prejudicial in that an individual can very well be innocent of a the crime for which he or she is arrested but never given the opportunity to testify or defend themselves because for one reason or another, the prosecutor declined to file charges or dismissed the case. A conviction, on the other hand, is a different matter and perhaps it would make sense to disclose it before the background check since they’re likely to find it. As far as your arrest goes, I would highly recommend that you speak to an attorney because California law haas changed to allow individuals like yourself who’ve been arrested for a crime but never convicted ti petition the court to have all records of that arrest completely sealed and destroyed so this would issue wouldn’t come up in this instance, or any future ones. These petitions are generally granted in my experience so it would be a big mistake not to pursue getting these arrest records sealed and destroyed. ... Read More
Q. If you have failure to appear in court will they suspended your DL
A: Whether or not your failure to appear in court will result in a license suspension depends on what type of case you failed to appear for. For example, if this was a traffic related matter, then yes, the court will notify the DMV of your failure to appear and it will likely result in a license suspension from the DMV. Failures to appear or FTA's are the most common type of license suspension matters and are also the easiest to fix. Basically, you need to go to the courthouse or call the courthouse (check their online website first) to request to add the matter back to calendar. You must then appear for that court date and ask for the FTA to be recalled and this will most likely remove the hold or suspension on your license. If you need to check on the status of your license, you can do so at the DMV website, www.dmv.ca.gov or by calling the Mandatory Actions Unit at (916) 657-6625. ... Read More
Q. Who should I contact?
A: Whenever anyone is taken into custody, like in this case by the CHP, they are taken to the local county jail. So the first thing you need to do is identify which county he was arrested in so you can determine which jail he’s presently being held. Once you know which jail holds inmates arrested in a given county, you can then access the jail inmate locator on the main jail website. Enter your husband’s details and then you should be able to get basic arrest information which often includes the charges he was arrested on, the bail amount so he can be released, his case number and any future court dates. Using this information, you can also access the county superior court website, criminal division, to get more information about his case. Depending on the type of case, he may have a posted bail amount. You can either post that amount with the county or go to a bail bondsman who will pay the bond and get him released for approximately 10 percent of the bail. This money is non refundable so sometimes it’s better to wait for the court hearing so he can request release on his promise to appear or OR. Anytime someone is in jail you need a lawyer.
