Q. I asked my public defender to file a motion and a affidavit I wrote up.and he told me they don't do that. Is he correct
A: Your attorney has no obligation to file what you write, and it might be impermissible for your attorney to file it. However, it would be pretty stupid for your attorney to ignore it, and your attorney should provide you with an explanation of what the attorney chooses to do.
Q. What type of lawyer handles malpractice suits against law firms handling VA Disability claims?
A: Any lawyer licensed to practice in the State in which you reside or the State in which your disability attorney resides. You can also hire an attorney outside of both States, if a local attorney will sponsor the outside attorney.
