EXPERIENCED | COST EFFECTIVE | THOUGHTFUL | TIMELY | TRUSTWORTHY

For over twenty-nine years Paul M. Gaide’s practice has emphasized superior representation of clients in state and federal courts, and in transactions.

Q. 50-50 custody, ex just packed up our 12-yr-old's belongings and told me to come pick her up, which I did. Do I need to
A: If your child's father is certain that he wants a long term change in parenting time, and the same is in the best interest of your child, the least expensive and quickest manner to achieve a Court's recognition of the change is to enter into a Stipulation to Modify Parenting Plan and submit the same to the Court for an Order adopting the same, as being in the best interest of the child. You may have to weigh whether to seek a change in child support, and if so, now or at a later date. I hope this helped.
Q. Can I potentially fight for more custody given what was in the CFI report ?
A: Dear Denver: You can use the CFI report to support your positions. The critical point which the Court will be seeking to determine is whether the conduct of either party negatively impacts the child(ren) at issue, and if so, how to best deal with such conduct. Paul M. Gaide, Esquire
Q. Married in Colorado. I bought house before we were married it's in my name. IAM the only one that works.
A: Generally speaking, in a dissolution of marriage case in Colorado, the Court must determine if assets are "property," and if "property," the Court must then determine if the property is "separate" or "marital," before allocating "marital" property to the parties. From what you have said, I have no doubt that the Court would find the residence to be "property," and if you have maintained the property solely in your name, the Court would allocate it to you as your "separate" property, but for any appreciation in the value of the property since the date of marriage. Your spouse would have a claim to an equitable portion of the increase in value of the property since the date of marriage, if any.
