Randy Walton was born and raised in Southern California native, and while is law firm is based in Northern San Diego County, he takes cases in all Southern California counties. Walton Law Firm represents individuals and families in a variety of personal injury and wrongful death matters, including motor vehicle accidents, work injuries, property injuries, and injuries to the brain and spine. No matter the size of the case, or the magnitude of the harm, Mr. Walton believes strongly that those harmed by the negligence or carelessness of others deserve justice for their injuries. As a result, he has collected tens of millions of dollars for personal injury victims and wrongful death heirs.
A portion of Mr. Walton's practice is also dedicated to the prosecution of nursing facilities, including nursing homes (skilled nursing facilities), residential care facilities, and assisted living facilities, including home health care, in cases involving the physical abuse and neglect of the elderly and dependent adults. The neglect and abuse of our elders (and dependent adults) is a growing concern in the United States, and Mr. Walton is dedicated to helping those who have been victimized by neglect or abuse.
Mr. Walton also dedicates a significant amount of time to his community. He served for four years as an elected member of the San Marcos City Council, and for 10 years previous to that he served as a member of the Governing Board of the San Marcos Unified School District, a school district that serves over 20,000 students. He also is the founder of Project Next, an organization dedicated to helping high school students navigate a life beyond high school. Mr. Walton has been active in local youth sports for many years. He coached the San Marcos High surf team to three state titles.

- Q. What are my rights if my mom passed away due to Skilled Nursing Facility Neglect?
- A: I'm sorry for your loss. Yes, the way to evaluate whether or not you have a viable case for neglect is to have it reviewed by a lawyer with experience in those cases. Even though there may be an issue around the POLST, it doesn't automatically mean the case is viable. The actual cause of death it's going to be very important in the analysis, so if the death was recent, it's always a good idea to talk to a lawyer as soon as possible. Best of luck to you.
- Q. Why is it so difficult to find a lawyer for Dependent Adult Financial Abuse case when EADACPA awards attorney fees?
- A: It is not clear what you mean when you say the case has already been "proven" in court, but the remedies of attorneys' fees and punitive damages you mention are only realized after a verdict. That means your case must be tried, which you probably know is a long and expensive pathway. If your case is really good, that is you can meet the higher burdens of proof set forth in EADACPA, then you should have no problem finding a lawyer (I don't do the financial abuse cases), especially if the defendant is someone who can pay an award. If the abuser is someone who could not likely pay an award, then that could be an obstacle to finding a qualified lawyer too. Good luck.
- Q. Live in California and was injured in Hawaii on vacation.
- A: Your best bet would be to talk to a personal injury lawyer on the island where you suffered the injury. In cases like this, I think hiring local counsel is usually the best way to go. Good luck.
