Q. How can we dissolve a prenuptial agreement signed in Louisiana?
A: Short version is that I highly recommend that you hire an attorney to prepare the paperwork to make sure it is done correctly as at some point in time in the future you do not want to have someone go back and say the agreement is void or not enforceable because it was not done correctly. If I remember correctly, you need to file something in district court/family court asking the Judge to dissolve the prenum because you want to go to a community property regime. But you really need to speak to a family/community property lawyer to make sure this is what is really wanted. Good luck.
Q. Can my ex-wife request child support after initially declining it?
A: Yes, she can but she can only receive child support from the date of (new) filing. Also, the reason(s) she declined child support before may be relevant to the child support amount moving forward----my recommendation is that you at least have a sit down consult with a lawyer in your area to discuss the specifics of your situation and then determine whether or not you want to hire a lawyer at that time to represent you. Q. Can I appear in court anytime within 10 days after service without risking default?
A: The Petition is the vehicle which starts the process to obtaining a judgment against you. The citation attached with the petition should tell you how many days you have to respond (or Answer) the petition before the petitioner may seek a default judgment against you----based on your post, it sounds like you have 10 days. My suggestion is that you contact a lawyer in your area to discuss the specifics of your situation and whether or not you want to hire a lawyer to prepare an Answer and represent you. Good luck.
