- A: A hair follicle exam can be a perfect way for you to alleviate any and every concern as it provides a historical assessment of your consumption of anything illegal. But, I would need to know more about your situation to determine whether her requests are excessive. Are there court orders in place which allow her to demand testing? And obviously if you are concerned about the results of a potential hair follicle exam, you should discuss your options with a qualified counsel.
A qualified and experienced family law attorney can of course assist you in considering your options and then getting where you need to be. Most of us offer free, 1/2-hour consultations, in which your matter can be discussed ... Read More
- Q. What are my after judgment options to file besides appeal in Arizona family court?
- A: You need to file your Notice of Appeal on or before the 30th day after the entry of the ruling on your rule 83 motion. You cannot be one day late. Filing a rule 84 motion will NOT expand the time frame. Filing a rule 85 motion will NOT expand the time frame for the underlying ruling which denied your rule 83 Motion.
Again, there are exceptions and I would need to know more to give you more precise advice.
Please come in soon. We can certainly help you consider and then pursue your ... Read More

- A: If the child has not lived in Arizona for the greater part of the last 6 months, then Arizona does not have “home state jurisdiction”. Currently, the matter would LIKELY have to be pursued in Ohio. I WOULD NEED TO KNOW MORE to determine if there are other theories that would allow Arizona jurisdiction over the child custody matter.
If you are able to litigate in Arizona, one of the two parents would likely be awarded primary parent status with the other parent having a long-distance parenting plan due to the distance between you. Which parent that is would be decided by the Court using factors to determine what is in the child’s best interests. With respect to which state has jurisdiction, ... Read More
