- Q. Can I get a case dropped/dismissed if I wasn't read my Miranda rights at time of arrest?
- A: Ms. Rogers is entirely correct. Unfortunately TV and Movies have been getting the Miranda warnings wrong since the day after the Supreme Court issued it's ruling requiring them.
- Q. Charged in 2017. Utah code 76-6-506.3 and.2. Does Statute of limitations apply? A warrant was put out Sept. 2023
- A: You will need to change your location to Utah to get a good answer. Right now your question is going to Missouri attorneys and you need a Utah criminal defense attorney to answer your question.
Statues of Limitations are state laws so Utah can and likely does have a different statue of limitation than Missouri. Even if they were written the exact same way Utah Courts will likely have interpenetrated them differently.
- Q. My visitation with my children is not being honored. My complaint to the police went nowhere.
- A: You will have to take her back to court. The legal system is not self actuating and you have to bring a petition for family access and motion to modify to would likely be in order too. You need to speak to a family attorney.
