When you were married, you never expected that your vows would land you in divorce court. You expected fulfillment from and for your spouse for a lifetime. Instead, you have ended up in court, paying lawyers potentially tens of thousands of dollars and a lifetime of hostility for your now former life partner. I concluded that there MUST be a better way to dissolve a marriage.

One Day Divorce Mediation was born from my desire to do something positive for my clients. Too often, the process of divorce itself is destructive. I wanted to create a better way. One Day Divorce is my answer to the costly, stressful, and uncertainty connected to a traditional litigated divorce.

The promise of One Day Divorce Mediation, available through Leskin Law & Mediation, is that parties will know exactly when their divorce will be final. They will know exactly how much it will cost. They will not be in an adversarial posture with their spouse. The One Day Divorce process relies on mediation and binding arbitration to insure both fairness throughout the process, efficiency and cost savings.

In traditional litigation, you will be required to mediate your case with your spouse. The courts require this. You can spend $10,000 (per spouse) to get your case ready for mediation, have the mediation and find yourself still going to court when you and your spouse cannot agree. Or, you can skip the expense, and go through a One Day Divorce, and mediate with certainty that your case will be resolved without going to court.

Q. How do I petition the court for visitation with my 2 children if I don't know where they are? I live in Oregon.
A: You do not give enough information to meaningfully answer this question.

Has there been a custody proceeding between you and the mother? Has there been any other court involvement? Are you currently paying child support? Were you and the mother married? Was there domestic violence between you and the mother?

You will need to locate the mother to either file: 1) A custody petition; 2) an enforcement action; 3) or a modification of an existing parenting plan. It will be difficult to serve the mother if you do not know where she is, and ultimately it will not matter if she never get served the new judgment or enforcement action.

Q. Can I get my driver's license suspension for back child support lifted?
A: You need to contact Oregon Department of Justice/Child Support Division and request that they notify Oregon DMV that your child support is current. Once DMV is notified, DMV should reinstate your license.
Q. In California can friends make end of life decisions based on an emergency contact when the next of kin is available.
A: A "friend", whether it is a romantic partner or a life long friend or even man's best friend, has no rights to make end of life decisions unless that person is named in an advance directive as the decision maker. The hospital will have a procedure it follows for making these crucial decision in the absence of a spouse or parent (or sibling). That procedure may involve seeking input from a friend, but the friend does not have the right to make those decisions.
