Biography

For over 6 years I served as a Deputy District Attorney in 2 of Oregon's busiest DA's offices. I prosecuted countless cases, including being the lead trial prosecutor in over 100 criminal trials, the majority of which were jury trials. I charged, negotiated, and tried every kind of DUI case imaginable, as well as many other types of misdemeanor and felony criminal charges. I now focus my DUI practice on representing 1st-time DUI drivers who desire a concierge experience in the court system. Rather than simply focus on helping clients enter DUI Diversion or otherwise quietly resolve their case, the Oregon Diversion Firm proactively plans with DUI clients who need and value legal services above and beyond the "average" DUI firm. We work with clients to protect and manage impacts to their business or employment; their professional license; and any other impacts of concern.

Over the course of 3 years, I focused on honing my skills as a trial lawyer, and brought my career trial total as lead trial prosecutor to over criminal 100 cases, most of which were jury trials. This gave me valuable insight into how judges and juries decide cases, and allowed me to develop the skills and experience it takes to present my client's case effectively. I prosecuted every type of DUI imaginable, and many types of other misdemeanor and felony criminal charges. This meant deciding whether to charge somebody with a crime, negotiating plea deals, and taking the cases to trial. It also meant working with police officers to write and execute search warrants, and as well as preparing police officers and others to testify for the State.

I prosecuted a variety of misdemeanor criminal cases, including DUI's, and was lead trial prosecutor in almost 20 criminal cases, most of which were jury trials. This gave me a sense of how and why judges and juries decide cases. I also supervised the Support Enforcement Division for the Gresham branch of the DA's office. This meant that I gained insights into how the State establishes, modifies, and enforces child support orders; this office also enforced spousal support orders, as well. Continuing with child and spousal support, I also prepared, charged, and filed criminal contempt charges to go after people who were not paying support, and learned how the prosecution and judges make decisions in these cases.

Legal Answers
Q. Important questions to ask in DUII in Oregon?
A: One of the most important questions to ask your attorney is what experience they have in prosecuting or defending DUI cases. Many attorneys would have to say "none." Remember, attorneys are just like any other profession--you need to ask questions to make sure your attorney has the kind of experience that work to your advantage.
Q. I had a DUII in 1998 and another one in 1999 another in 2009. My license is now revoked. Can I ever get it back?
A: It sounds like your driver's license for revoked for life. A "lifetime" revocation means that your driver's license is "permanently" revoked. But, after the passage of time, you may be able to get your license back. A skilled attorney can review your criminal history and explain DMV's regulations to you, so you know when and how you can get your license back.

Q. I need to know if it would be better to go to trial or take the plea for felony possesion
A: It depends on what you mean by "felony possession." Of a firearm? Drugs? Generally, in addition to the type of charges involved, your criminal history, being on probation or parole, and the facts of your cases are the biggest factors. A skilled defense attorney can help you weigh the pros and cons of taking the case to trial v. pleading the case out, and help you decide if you can be the charge in your case.
