- Q. How to respond to $25,000 legal fees request in GA divorce?
- A: First, you should make sure all of your contact information is correctly on file with the court. Second, you should ask them the reason they are requesting attorney fees. There are different legal arguments to be made to obtain attorney fees in a divorce therefore the reason is very important to whether they are likely to be successful. Thirdly, you should brainstorm with trusted friends and family on how you can obtain representation in your case. Your financial situation may get drastically worse without an attorney compared to making some immediate sacrifices for your long-term best interests.
- Q. Steps to take if will is not available and probate not started.
- A: You can move forward with probating the estate and requesting to be the personal representative. At such time, if someone has the Last Will and Testament, they can object. They would then need to produce the Last Will and Testament. From the form of the statements above, it seems you assume that the Last WIll and Testament was properly executed and that the original or copy has been found. Until you have seen it, you do not know. Additionally, you should consider the fact that you may be getting a different share of assets if there is deemed to be a valid Last Will and Testament versus there not being one.
- Q. Can alimony be contested after final divorce if ex has made no attempt to get a job... refused some items in decree.
- A: Whether alimony can be modified is evaluated by how your Final Judgment and Decree of Divorce is written. You must have an experienced attorney review it and advise you accordingly.
Additionally, if your ex-wife is not following the Decree, you have the right to pursue action against her in court.
If the children are feeling tension, you may want consider putting them in therapy so they have someone confidential that they can work through their problems with.
