Biography

Todd is a Utah Licensed Attorney and the founder of Peterson Legal PLLC. Todd has been practicing criminal defense for 6 years now and has helped hundreds of clients navigate the stressful criminal justice system. After graduating from BYU with a bachelors in Economics, Todd attended Seattle University School of Law in Seattle, Washington. Upon completing his first year of law school, Todd transferred back to his home state of Utah to finish up law school and graduate from the S. J. Quinney College of Law at the University of Utah. During law school, Todd worked as a law clerk for Salcido Law Firm, as well as interned at the Salt Lake Immigration Court.

Since his admission to the Bar, Todd has worked for Salcido Law Firm practicing primarily in criminal defense and family law. Todd has had the great opportunity of working with hundreds of clients in some of the most difficult periods of their lives. Additionally, Todd has traveled throughout Utah appearing in justice, juvenile, and district courts and has developed relationships with judges and prosecutors alike.

Todd has a drive to represent people facing criminal charges and making sure their rights are protected. Along with defending your rights, Todd understands that facing criminal charges is a very stressful and scary thing and he is passionate about working to alleviate as much of the stress as possible. When not working with his clients or appearing in court, Todd enjoys playing music and spending time in the outdoors with his two sons.

Q. In Tooele, Utah, can they hold someone in jail for more than 72 hours; and discount 48 hours over a weekend, and no holding charge?
A: Under Utah Rules of Criminal Procedure Rule 7, individuals arrested without a warrant must have a probable cause determination made within 48 hours, not counting weekends. However, this determination can be made by a judge without actually having the defendant in front of him/her so in a lot of cases a probable cause statement is submitted to the judge and he/she rules on it as well as sets initial bail amounts.

If an individual is picked up on a warrant then there is no 48 hour requirement.

Under both scenarios charges are to be filed without delay, which does not have a set deadline and usually just means as soon as the prosecutor can file the charges. In most cases in Utah charges are filed within a week of an individual being arrested. ... Read More
