- Q. Can my husband put me.in jail lying to police saying I did drugs planting them on me in my sleep
- A: It is unfortunate that your husband would do such a thing after supporting him for 25 years. You will need to hire an attorney to argue your legal defense and obtain the best possible outcome which should be the dismissal of your case under the provided facts and circumstances. If you do not have any criminal history/history of drug use and he does, then that is a factor that will come into play in your case as well on the issue of who the drugs belong to.
- Q. I have got a summons for court for not paying all my court fees and restitution. What should I look forward to?
- A: Not paying restitution and fees is a violation of probation. You can speak with your lawyer about sorting out and making all necessary payments before the court date. You should bring proof of such to court. The probation officer can also inform the court that you have made all necessary payments once it is done. On the court date, the judge will inquire as to why the restitution and fees were not paid. The judge can decide to modify, extend or revoke your probation and place you in jail. If you have not had any other problems while on probation, it is unlikely that the judge will revoke your probation and place you in jail.
- Q. Can I b convicted of possession of a controlled substance even if it wasn't found on me but in my belongings?
- A: If it is determined that you were in an area in which you had actual care, custody, control, or management of the drug substance such as a home, car, or bag, although it may not be actual possession in your case, it can be constructive possession. Therefore, the prosecutor can argue constructive possession to satisfy the possession requirement.
