Legal Answers
- Q. Now that Arizona has marijuana legal, can people on federal probation smoke with a marijuana card?
- A: State law changed but federal law did not. Federal courts and federal law enforcement are required to continue treating cannabis as a Schedule 1 controlled substance prohibited under federal law--nothing your state does.
Your probation will not allow you to smoke cannabis, even with a medical card, because smoking cannabis is illegal under federal law and any illegal acts are a violation of your probation.
- Q. How much trouble will I get caught in lax with one .05 gram thc cartridge over 18 but under 21
- A: Over or under 21, transporting cannabis products across state borders is illegal under federal law, and under the laws of most states...including legalized states like Washington and California. This small amount would likely only be seen as simple possession and not carry particularly stiff penalties but other statutes might apply that could increase the risk of fines or criminal charges. In short, don't fly with your vape.
