Brian Robert Gormley
Gormley Law OfficeBrian Gormley has a dynamic transactonal practice with tremendous experience representing clients at all parts of the continuum. Having worked with large institutions in the structured finance and capital markets world, developers, nonprofits and lenders in the multifamily housing market, and individual distressed homeowners and estates, he is familiar with all levels of clients and their associated needs. He has extensive real estate experience, representing clients in multifamily housing transactions, DC TOPA cases (tenant opportunity to purchase act), foreclosure defense and short sales, and as a title attorney and a real estate broker. He also has an active probate and estate planning practice, and is always looking to push the envelope to develop creative and innovative solutions to clients' unique and ever-changing needs. He has worked on and closed transactions totalling literally billions of dollars. That said, no client is too small. He enjoys taking the time to listen to individual concerns, and structure deals or negotiations accordingly. Attention to detail is a hallmark of a competent attorney, but the ability to transition to bigger picture analysis and generate solutions to practical constraints is what sets him apart.

- Q. In cases of multiple owners of a property, does majority rule on questions of selling, renting, etc?
- A: Each owner in a joint ownership situation would have a say. If there is a disagreement, then ultimately you need to seek a partition action to force a sale.
- Q. Probate, Trusts and an Un-trust worthy executor
- A: It's sometimes difficult to know how to handle delicate estate situations. As a beneficiary of a trust, you have the right to review the trust itself and receive periodic accountings. I would start there and see what information you get. Hopefully, you will not need to involve the courts in a breach of fiduciary duty/conversion action. Let us know if you need further assistance.
- Q. Hello, I will be inheriting $90,000. and live in Montgomery County Maryland will I be paying any MD or Federal taxes?
- A: If the sum total of the Estate is only $90,000, then you are well under state and federal thresholds for estate tax. There are several other fees you may have to handle - probate fees, capital gains, income tax, all depending on the nature of the assets in the estate. Please consult a qualified CPA/attorney to assess your potential liability.
